MARION, OH (MARION COUNTY NOW)—Attorneys representing Marion City Councilman Ayers Ratliff are intensifying their efforts to obtain evidence from Marion Prosecutor Ray Grogan, which they claim has yet to be provided to the defense.
In a motion filed on September 30, Ratliff’s legal team asserts that they are missing 15 key pieces of evidence that Grogan has failed to turn over.
The motion highlights concerns regarding Grogan’s handling of discovery, stating:
“Ray Grogan’s deplorable track record of providing discovery is consistent with his September 27, 2024 filing with this Court stating that, ‘Sadly, this Court has had to extend time to review a Motion to Dismiss and/or Compel based upon a discovery response.’ He has proven time and time again that he and his office do not take the constitutional rights of Defendants seriously by providing complete discovery.”
The motion further emphasizes Ratliff’s ongoing struggle to obtain this evidence, stating, “The Defendant reminds this Court that he has done nothing short of beg for this discovery and is asking this Court to ORDER the Marion County Prosecutor to provide complete discovery to the defendant forthwith or sanction the Marion County Prosecutor for failing to do so.”
Marion County Now reached out to Prosecutor Grogan for comment regarding the allegations and received this response: “The premise of your question is false. Sadly, there has been a great deal of misinformation about this case.”
