MARION, OH (MARION COUNTY NOW)—The Ohio Third District Court of Appeals has issued a decision on the appeal of a Marion woman.
In the case of State of Ohio v. Brandy N. Davis, the Ohio Court of Appeals affirmed the judgment of Marion County Court of Common Pleas Judge Warren T. Edwards, which had resentenced Davis to a prison term of 10 to 15 years following a remand.
Davis was originally found guilty of trafficking and possession of a fentanyl-related compound, both first-degree felonies. After an appeal revealed insufficient evidence to support the trafficking conviction, the court remanded the case for sentencing on the possession charge.
During the resentencing hearing on March 22, 2024, Davis expressed remorse and described her efforts for self-improvement while incarcerated. However, Marion County Common Pleas Court Judge Edwards imposed the maximum sentence, citing factors including her criminal history and lack of genuine remorse.
Davis appealed, arguing that the court erred by not considering mitigating circumstances and imposing the maximum sentence. The appellate court found no error prejudicial to Davis and upheld her sentence.
