BUCYRUS, OH (MARION COUNTY NOW)—Timothy Montgomery, formerly of Crestline, was denied his appeal before the Third District Court of Appeals on Monday.

Montgomery challenged the rulings and sentencing of Judge Sean Leuthold and the Crawford County Common Pleas Court, which found him guilty of two counts of murder.

Montgomery argued on appeal that 1) the trial court’s verdict was not supported by the weight of the evidence and 2) the trial court made incorrect rulings regarding the admission of evidence.

In its ruling, the Third District Appellate Court said:

“Having found no error prejudicial to the Appellant in the particulars assigned and argued, the judgment of the Common Pleas of Crawford County is affirmed.”

Montgomery is currently serving a term of 15 years to life in prison. He must serve 15 years before eligibility for parole for the brutal murder of Michael “Mikey” Benedict in October of 2021.
