DELAWARE, OH (MARION COUNTY NOW)—A notable resignation has taken place within the Delaware County Prosecutor’s Office, as an assistant prosecutor has stepped down amid allegations against Judge James Schuck, who is set to return to the bench.

The resignation, effective May 11, was submitted on Monday. Judge Schuck, 50, had been on a voluntary leave since November following allegations of stalking made by a 25-year-old woman employed in the prosecutor’s office. While no formal charges have been filed, there is an ongoing investigation that includes potential rape.

The assistant prosecutor’s resignation letter expresses deep concern over the situation, as the woman accused Judge Schuck of coercing her into sexual encounters and persistently reaching out to her despite her requests for him to cease contact. She also claims he violated a protection order. Schuck has categorically denied all allegations against him.

In her resignation letter, the woman stated, “I have suffered, and continue to suffer, from the effects of a wrongful, power-imbalanced relationship with Judge Schuck.” She emphasized that under the circumstances of his anticipated return, she felt compelled to resign from her position. 

Despite the difficulties in her decision, she expressed gratitude for her time spent serving in the Delaware County Prosecutor’s Office.
